Dear DAWN NEERING-MARSHALL:
If you worked as a Telephone-Dedicated Customer Service Employee
for CVS Health Corporation Caremark PHC, LLC or Caremark LLC (collectively, “CVS”)
at a Call Center, you may be entitled to participate in a lawsuit
seeking unpaid overtime wages.
Why Am I Getting This Notice?
You have been identified as an individual who worked at a CVS Call Center as a Telephone-Dedicated Customer Service Employee
(including Customer Service Representatives and Customer Care Representatives) between January 1, 2013
and the present. If you have received this Notice, you may be eligible to participate in this lawsuit.
What’s This About?
The plaintiffs say that CVS required them to arrive at CVS prior to the start of shifts to do certain work (such as turning on, booting up your
computer and getting programs ready) to be “call ready” before shifts started. The lawsuit alleges that CVS did not pay for this required work.
CVS denies these allegations, and says it has paid customer service reps for all time required. The Court has not determined who is right.
You have a choice to assert your legal rights in this case if you desire to do so. If you do not do so, you will keep the right to assert any claims you
may have on your own, but you will also not share in any money awarded in the case.
What Are My Choices?
If you choose to join in this case, you will be bound by the result in this case, whether it is favorable or unfavorable. If the attorneys get money or
benefits for the employees, they may ask the Court for fees and expenses. You won’t have to pay these fees and expenses. If the Court grants the
lawyers’ request, the fees and expenses would be either deducted from any money obtained for the Class or paid separately by CVS. If the case
does not settle and plaintiffs lose at trial, there is a possibility that the court could assess costs to the plaintiffs as a group.
If you do not wish to join the lawsuit, you are free to take action on your own or do nothing.
What Relief are Plaintiffs Seeking?
Plaintiffs are seeking amount up to two times the alleged unpaid wages as well as attorneys’ fees and costs.
Can I be Fired or Retaliated Against?
CVS will not retaliate against you. The FLSA prohibits your employer to terminate or take any adverse action, as defined by the law, as a result
of your decision to participate or not in this suit.
How Do I Join the Lawsuit?
If you want to participate in the lawsuit, fill out the enclosed Consent to Join form and mail or fax it back. It must be received by
December 6, 2016. You may also submit it by going to www.cvsovertimelawsuit.com
and following the instructions there.
